Syrian helicopter gunships strafe Aleppo rebels

Regime forces on Monday strafed rebel-held districts in Aleppo with helicopter gunships and pounded them with shelling on the third day of a pitched battle for Syria's most populous city.

The fighting has sent some 200,000 civilians fleeing the northern city, according to the UN which warned of a looming humanitarian catastrophe, while France said it would call an urgent UN Security Council meeting on Syria.

The shelling was focused on the southwest district of Salaheddin, a stronghold of the rebel Free Syrian Army, made up of deserters and armed civilians, said the Syrian Revolution General Commission.

Colonel Abdel Jabbar al-Oqaidi, head of the FSA military council of Aleppo, said that "several quarters of Aleppo are being bombed with MiG (fighter jets) and helicopters."

The Local Coordination Committees, made up of activists on the ground, said the eastern neighbourhood of Sakhur was also hit by shells and by machinegun fire, with regime forces deploying helicopter gunships against the rebels.

The Syrian Observatory for Human Rights, meanwhile, said that clashes between troops and rebels erupted early morning near the air force intelligence headquarters in Aleppo's Zahraa district.

Just outside of Aleppo, the country's most populous city, rebels seized a strategic checkpoint after a 10-hour battle, a FSA commander and an AFP journalist said.

"The Anadan checkpoint... was taken this morning at 5:00 (0200 GMT) after 10 hours of fighting," said General Ferzat Abdel Nasser, a rebel officer who deserted the Syrian army a month ago.

By securing the checkpoint, about five kilometres (3.8 miles) northwest of Aleppo, the rebels now control a direct route between the Turkish border and the commercial capital.

An AFP journalist on the ground said that the rebels captured seven tanks and armoured vehicles, and destroyed an eighth vehicle.

Six soldiers were killed and 25 were taken as prisoners, General Ferzat told AFP by phone, adding that four of his own men died in the fighting.

The Syrian army, meanwhile, claimed to have during the night overrun part of Salaheddin, the rebels' main bastion in Aleppo, but the claim was denied by the FSA's Colonel Oqaidi.

"The Syrian army took control of part of Salaheddin district and continues its offensive," a security source in Damascus told AFP.

However, Oqaidi insisted government troops had "not progressed one metre."

"We launched a new assault from Salaheddin during the night, and we destroyed four tanks," the rebel commander told AFP.

Since the launch on Saturday of the regime assault on Aleppo, the FSA "has already repelled three offensives" against Salaheddin, he said, adding that the rebels controlled "between 35 to 40 percent of Aleppo."

Rami Abdel Rahman, the head of the Britain-based Observatory, said that regime forces were on Monday "just reaching the outskirts of the (Salaheddin) neighbourhood."

Monday's violence followed a bloody day in which 125 were killed across Syria -- 46 civilians, 45 soldiers and 34 rebels -- according to the Britain-based Observatory.

UN humanitarian chief Valerie Amos said in a statement that an estimated 200,000 people had fled from Aleppo in two days and an unknown number were still trapped in the city.

Amos said in New York on Sunday that she was "extremely concerned by the impact of shelling and use of tanks and other heavy weapons" on civilians in Aleppo, Damascus and other locations.

She said that many people in Aleppo had sought shelter in schools and other public buildings. "They urgently need food, mattresses and blankets, hygiene supplies and drinking water."

US Defence Secretary Leon Panetta warned Syrian President Bashar al-Assad that the assault on his own population in Aleppo would be a nail in his coffin.

"It's pretty clear that Aleppo is another tragic example of the kind of indiscriminate violence that the Assad regime has committed against its own people," Panetta told reporters on a military plane en route to Tunisia.

"And in many ways, if they continue this kind of tragic attack on their own people in Aleppo, I think ultimately it will be a nail in Assad's coffin," he said.

"He's just assuring that the Assad regime will come to an end by virtue of the kind of violence they're committing against their own people."

French Foreign Minister Laurent Fabius said in Paris on Monday that France, which is taking over the UN Security Council's rotating presidency in August, will call an emergency ministerial meeting on Syria.

Fabius told French radio station RTL he would chair the meeting himself and that it had to be held urgently to stop Assad's regime carrying out massacres in Syria.

More than 20,000 people have been killed in Syria since the anti-Assad revolt began in March 2011, according to the Observatory. There is no way to independently verify this figure, while the UN has stopped keeping count.

Bone tissue engineering: Attaching proteins for better regeneration

ScienceDaily (July 26, 2012) ? Researchers in Japan demonstrate a new protein binding approach for effectively promoting bone regeneration. Current treatments for bone defects and bone tissue regeneration have significant limitations. Now a new method that immobilises a fusion protein in a hybrid collagen-polymer supportive scaffold shows promise for bone tissue engineering.

Guoping Chen, Yoshihiro Ito and researchers at the Tissue Regeneration Materials Unit, International Center for Materials Nanoarchitectonics (MANA), National Institute for Materials Science, RIKEN, the Immuno-Biological Laboratories Co., Ltd, and the National Institute for Child Health and Development, Tokyo, added a collagen-binding domain from fibronectin to BMP4, a protein that promotes bone regeneration. The new fusion protein, BMP4-CBD, was used in a scaffold of natural collagen sponge and a strong synthetic polymer, poly(lactic-co-glycolic acid) (PLGA). The scaffold provides space and support for the bone cell growth.

The researchers investigated the BMP4-CBD immobilized on the collagen-PLGA scaffold cultured in vivo for four weeks. They compared the approach with a range of controls including scaffolds with wild-type BMP4 without the collagen-binding domain and scaffolds with just the collagen-binding domain. The expression of specific and non-specific osteogenetic markers used as indicators of bone tissue regeneration was much higher for BMP4-CBD. Using BMP4-CBD also initiated calcification.

"These effects should be attributed to the retention of more effective molecules due to the specific binding of the fusion BMP4 to the collagen," say the authors. The stimulation effect of the protein promoting the bone regeneration is thus maintained over a longer period. The research may benefit patients suffering from bone defects in the future.

To commemorate her quest to become the first American to win an individual-sport medal in five straight Olympic Games, Rhode's family made a small number of pins. The image: She's standing on Tower Bridge, larger than life, taking aim at an unseen target, with the U.S. and British flags below.

The family said it received approval from the U.S. Olympic Committee to use an image of the Olympic rings on the pin.

Rhode's signature is etched on the back, as are the years of her now-five Olympic appearances.

Tech titans face off in court over iPhone, iPad

Two tech titans will square off in federal court Monday in a closely watched trial over control of the U.S. smart phone and computer tablet markets.

Apple Inc. filed a lawsuit against Samsung Electronics Co. last year alleging the world's largest technology company's smart phones and computer tablets are illegal knockoffs of its popular iPhone and iPad products. The Cupertino-based company is demanding $2.5 billion in damages, an award that would dwarf the largest patent-related verdict to date.

Samsung counters that Apple is doing the stealing and that some of the technology at issue ? such as the rounded rectangular designs of smart phones and tablets ? have been industry standards for years.

The U.S. trial is just the latest skirmish between the two over product designs. A similar trial began last week, and the two companies have been fighting in courts in the United Kingdom and Germany. The case is one of some 50 lawsuits among myriad telecommunications companies jockeying for position in the burgeoning $219 billion market for smartphones and computer tablets.

In the United States, U.S. District Court Judge Lucy Koh in San Jose last month ordered Samsung to pull its Galaxy 10.1 computer tablet from the U.S. market pending the outcome of the trial, though the judge barred Apple attorneys from telling the jurors about the ban.

"That's a pretty strong statement from the judge and shows you what she thinks about some of Apple's claims," said Bryan Love, a Santa Clara University law professor and patent expert. Love said that even though the case will be decided by 10 jurors, the judge has the authority to overrule their decision if she thinks they got it wrong.

"In some sense the big part of the case is not Apple's demands for damages but whether Samsung gets to sell its products," said Mark A. Lemley, a Stanford Law School professor and director of the Stanford Program in Law, Science, and Technology.

Lemley also said a verdict in Apple's favor could send a message to consumers that Android-based products such as Samsung's are in legal jeopardy. A verdict in Samsung's favor, especially if it prevails on its demands that Apple pay its asking price to certain transmission technology it controls, could lead to higher-priced Apple products.

Lemley and other legal observers say it's rare that a patent battle with so much at stake doesn't settle short of a trial. Court-ordered mediation sessions attended by Apple's chief executive Tim Cook and high-ranking Samsung officials failed to resolve the legal squabble, leading to a highly technical trial of mostly expert witnesses opining on patent laws and technology. Cook is not on the witness list and is not expected to testify during what is expected to be a four week-trial.

Lemley, Love and others says it also appears that Apple was motivated to file the lawsuit, at least in part, by its late founder's public avowals that companies using Android to create smartphones and other products were brazenly stealing from Apple. To that end, Samsung's attorneys made an unsuccessful pitch to have the jury hear excerpts from Steve Jobs' authorized biography.

"I will spend my last dying breath if I need to, and I will spend every penny of Apple's $40 billion in the bank, to right this wrong, I'm going to destroy Android, because it's a stolen product," Jobs is quoted as saying in Walter Isaacson's book "Steve Jobs" published in November. "I'm willing to go thermonuclear war on this."

But the judge barred those statements in a ruling earlier this month.

"I really don't think this is a trial about Steve Jobs," Koh said.

In court papers filed last week, each company laid out its legal strategy in so-called "trial briefs."

Apple lawyers argue there is almost no difference between Samsung's products and Apple's and that the South Korean company's internal documents show it copied Apple's iconic designs and its interface.

"Samsung once sold a range of phones and a tablet of its own design," Apple lawyers argue in their documents filed Wednesday. "Now Samsung's mobile devices not only look like Apple's iPhone and iPad, they use Apple's patented software features to interact with the user."

Samsung denies the allegation and counter-charges that Apple copied its iconic iPhone from Sony. Samsung lawyers noted that the company has been developing mobile phones since 1991 and that Apple jumped into the market only in 2007.

"In this lawsuit, Apple seeks to stifle legitimate competition and limit consumer choice to maintain its historically exorbitant profits," Samsung lawyers wrote in their trial brief also filed Wednesday. "Android phones manufactured by Samsung and other companies ? all of which Apple has also serially sued in numerous forums worldwide ? offer consumers a more flexible, open operating system with greater product choices at a variety of price points as an alternative to Apple's single, expensive and closed-system devices."

"Between 2005 and 2010 alone, Samsung invested $35 billion in research and development relating to telecommunications technology, with over 20,000 engineers worldwide dedicated to telecommunications research and development," Samsung's lawyers wrote.

"One thing that is notable is that this trial is happening at all," said Love, the Santa Clara law professor and patent expert. He said that in an industry such as this where so many companies hold so many vital patents needed by all players, lawsuits are viewed as toying with "mutually assured destruction" and that most disputes are solved through "horse trading" and agreements to share intellectual property and royalties.

Business owners would do just fine without government. But government, government employees, and the ?takers? of society ? those who take checks from government ? could not survive without us ? the creators, producers and taxpayers. Simply put, we pay all the bills for government. We?re the ones you ought to be thanking.

Let me paint a picture even an economic illiterate can understand. Let?s say you own a restaurant. Who needs whom? Do the patrons of your restaurant need you? No, they could choose any one of 1,000 other restaurants in your city. They could stay home and cook for themselves. Heck, they could even choose to not eat ? most Americans could use a day off from eating.

But you ? the business owner ? could not live without customers. You desperately need their patronage. You need to be nice, genuflect and show gratitude. Without customers, you could not stay in business. Every employee of your restaurant is dependent on customers. Even ignorant leftists and socialists can?t intelligently argue with that.

Now let?s extend that ?business model? to government. Government is the business. The taxpayers are the customers ? just like that restaurant example. Government doesn?t survive if we don?t pay the bills. Government is dependent on us?our hard work?our taxes. If we go on strike and stop paying, government goes out of business.

The only difference is that in a free market capitalist society, the customer freely chooses to spend his or her money at the business of their choice. But in the case of government, the customer is limited to only one choice. If government can?t pay the bills, instead of being forced out of business, government just raises taxes and extorts more money (legally, of course).

SPIN METER: Obama's 'You didn't build that' echoes

WASHINGTON (AP) ? Mitt Romney says Barack Obama doesn't think entrepreneurs built their businesses. The problem is that's not what the president said.

The brouhaha over Obama's comments on small-business success shows no sign of fading and the president pushed back hard with new ads scheduled to run in Virginia, North Carolina, Florida, Ohio, Iowa and Nevada in which the president directly counters Romney's claims. Romney and his allies continue to hammer Obama for comments taken wildly out of context, pummeling the president as a government-obsessed figure who thinks Washington gets the credit for the success of small businesses.

That was not Obama's point when he spoke in Virginia on July 13 about the government's supportive role in providing a stable environment in which businesses can thrive. Nor was it Romney's point when he used similar phrasing in 2002 about Olympic athletes who benefited from supportive parents and coaches.

But in a campaign that makes facts secondary to a good attack, the context doesn't seem to matter.

"Those ads taking my words about small business out of context? They're flat out wrong," Obama says, looking into the camera and addressing voters in the 30-second ad. "Of course Americans build their own businesses."

That is a tidier version of what Obama offered in Virginia.

"Look, if you've been successful, you didn't get there on your own. You didn't get there on your own," Obama said then. "I'm always struck by people who think, 'Well, it must be because I was just so smart.' There are a lot of smart people out there. 'It must be because I worked harder than everybody else.' Let me tell you something: There are a whole bunch of hardworking people out there. If you were successful, somebody along the line gave you some help."

Obama cited teachers and mentors who helped "create this unbelievable American system that we have that allowed you to thrive. Somebody invested in roads and bridges."

Then, Obama teed up the line that left Republicans giddy. "If you've got a business, you didn't build that. Somebody else made that happen. The Internet didn't get invented on its own. Government research created the Internet so that all the companies could make money off the Internet," Obama said, returning to his thesis.

"The point is, is that when we succeed, we succeed because of our individual initiative, but also because we do things together."

Romney and his allies pounced on the "you didn't build that" portion and ignored the rest.

"Well, just read the whole speech. I found the speech even more disconcerting than just that particular line. The context is worse than the quote," Romney told CNBC on Monday.

"I cannot believe the president of the United States could say that I have not made this," one small-business owner says in a web video released Tuesday by American Crossroads, an independent group supporting Romney's campaign.

"When President Obama said in Roanoke that 'if you've got a business you didn't build that, somebody else made that happen,' I was personally extremely insulted," office supplier Melissa Ball of Richmond, Va., said on a Republican Party conference call with reporters.

Recognizing the potency of this theme, the Obama campaign began pushing back harder.

Speaking to about 1,000 donors in Portland, Ore., on Tuesday, Obama accused Romney of "twisting my words around to suggest that I don't value small business."

"Those are the games that are played in campaigns," he added. "Although I have to say, when people omit entire sentences from a speech and they start splicing and dicing, they may have tipped a little bit over their skis. They may have gone over the edge here."

The Obama campaign also released Web videos Monday and Tuesday rebutting Romney's assertions.

In one, the campaign accused the presumptive GOP nominee of having "deliberately altered the meaning of the president's words." A second video out Tuesday featured deputy campaign manager Stephanie Cutter, who said Romney was "not telling the truth about what the president said."

Taken as a whole, Obama's remarks aren't that different from Romney's comments in 2002 to Olympic athletes.

"You Olympians, however, know you didn't get here solely on your own power," Romney said after congratulating the athletes. "For most of you, loving parents, sisters or brothers, encouraged your hopes, coaches guided, communities built venues in order to organize competitions. All Olympians stand on the shoulders of those who lifted them."

Romney's team didn't seem to mind the risk. The backdrop for his campaign stop Monday in California: a blue banner that said, "We Did Build It!"

Penn State faced four-year 'death penalty'

Penn State students would have been more shocked had the NCAA handed down a four-year death penalty (Getty Ima??

In an interview with Yahoo! Sports' Pat Forde on Monday, NCAA President Mark Emmert revealed that members of the Division I Board of Directors discussed much more severe penalties than the ones actually levied against Penn State.

Now we know specifically what was on the table.

Emmert and Penn State President Rodney Erickson told ESPN's "Outside the Lines" on Wednesday that the majority of school presidents favored suspending the university's football program for four years.

Instead of either accepting that unprecedented punishment or forcing the NCAA to launch a formal investigation by refusing to accept sanctions, Erickson entered covert discussions with the NCAA in hopes of reaching a compromise that did not include the death penalty. The result was a defacto plea bargain in the form of the consent agreement Penn State leaders signed. In return for the NCAA taking the "death penalty" out of the punishment, Erickson agreed not to appeal penalties that included a four-year bowl ban, the nullification of 112 wins, massive scholarship reductions and a $60 million fine.

That Erickson negotiated that deal without consulting Penn State's board of trustees did not please everyone. The board of trustees met Wednesday with Erickson to discuss whether he had the authority to agree to the penalties without its approval and released a statement begrudgingly expressing its acceptance of the deal he negotiated.

"The Board finds the punitive sanctions difficult and the process with the NCAA unfortunate," the statement read.? "But as we understand it, the alternatives were worse as confirmed by NCAA President Mark Emmert's recent statement that Penn State was likely facing a multi-year death sentence."

Erickson might have put his own job in jeopardy by not keeping the board in the loop during his discussions with the NCAA, but he deserves credit for negotiating a far better deal.

As damaging as the current penalty is to Penn State, no football for four years would have been a crippling financial setback to the university. Without revenue from TV appearances or ticket and concessions sales, the school could only have funded its Olympic sports that rely on football money via private donations or increased tuition. Maybe supporting those programs for four years would have been possible, but it might have taken Penn State football a decade or two to recover from four years off.

The fact that the NCAA was considering a four-year death penalty for Penn State football once again calls into question whether it should have the authority to punish programs whose misdeeds are actual crimes rather than rules violations.

Yes, covering up child molestation allegations against Jerry Sandusky was an incredibly reprehensible action. Yes, the men responsible deserve to be held accountable. But coach Joe Paterno is dead, school president Graham Spanier has been fired, and suspended AD Tim Curley and now-retired school vice-president Gary Schultz are awaiting trial.

What purpose would it serve or problems would it solve for the NCAA to suspend Penn State football for four seasons and send the Nittany Lions to the depths of the Big Ten for countless more? Shouldn't the court system be the ones to punish the guilty parties rather than a group of PR-conscious school presidents pandering to an enraged public by enacting vengeance against Penn State football and demanding credit for it?

The precedent set by the actual punishment is still one that may make schools squeamish, but at least that penalty is less harsh.

Players who had nothing to do with the Sandusky cover-up and want to finish out their careers at Penn State can still do so. Students enrolling this fall won't have to go four years without attending a football game. And athletes in other sports at Penn State that rely on football revenue to survive won't have to search in vain for another form of fundraising.

Trial signals major milestone in hunt for new TB drugs

ScienceDaily (July 23, 2012) ? A novel approach to discover the first new tuberculosis (TB) combination drug regimen cleared a major hurdle when Phase II clinical trial results found it could kill more than 99 percent of patients' TB bacteria within two weeks and could be more effective than existing treatments, according to a study published July 23 in the Lancet. These results add to a growing body of evidence that the new regimen could reduce treatment by more than a year for some patients.

The findings from researchers and the non-profit TB Alliance raise hope for a treatment breakthrough amid the growing and dangerous epidemic of drug-resistant forms of TB that, in some cases, are becoming untreatable. The results, presented July 23 at the 2012 International AIDS Conference, also reveal progress in the pursuit of an antiretroviral-compatible TB treatment, which is critical to treating the millions of people with TB/HIV co-infection. Today, TB remains the largest killer of people with AIDS, but very often, TB and HIV treatments cannot be given together because of drug-drug interactions and side effects.

The clinical trial tested a combination of one completely novel drug candidate, a new TB drug candidate already approved to treat other infectious diseases, and one existing TB drug. These results, along with pre-clinical data, suggest that this novel combination could treat both drug-susceptible and some forms of drug-resistant TB in only four months. Currently, people with multi-drug resistant TB (MDR-TB) require 18 to 24 months of treatment. Even those with ordinary TB need six months of taking drugs every day.

"These findings confirm the promise of novel TB regimens to be shorter, simpler, safer, and, compared with today's MDR-TB drugs, much less expensive," said Mel Spigelman, MD, CEO and President of TB Alliance. "The next trial to advance this regimen is already underway. We now have real momentum toward bringing to market treatments that will ultimately help save millions of lives."

TB Alliance's push to test new drugs in combination has been done to produce a regimen that not only would be faster and easier for patients, but also would tackle two other challenges as a major step in stopping the spread of drug-resistant TB -- the complexity and high cost of treatment. This promising regimen eliminates the use of injectables and projects to reduce the cost of MDR-TB therapy by as much as 90 percent.

TB is one of the world's most ancient and deadly infectious diseases, dating back thousands of years and found in remains of Egyptian mummies. When HIV/AIDS exploded in the 1980s and 1990s, especially in sub-Saharan Africa, that epidemic triggered a historic jump in the number of TB deaths. An estimated 1.4 million people die from TB, and roughly 9 million people develop the disease, each year. One-third of all people on earth -- nearly 2.5 billion people -- have a latent form of TB.

The study, NC-001, or New Combination 1, was a two-week trial successfully completed at two centers in South Africa. It involved the new combination therapy called PaMZ, consisting of the novel TB drug candidate, PA-824; moxifloxacin, an established antibiotic not yet approved for use in first-line TB therapy and being developed in partnership with Bayer Healthcare AG; and pyrazinamide, an existing TB drug. NC-001 was funded by the Bill & Melinda Gates Foundation, the United States Agency for International Development, UK aid, and Irish Aid.

"Treating drug-sensitive and drug-resistant TB with the same regimen can simplify the delivery of TB treatment worldwide," said Andreas Diacon, MD, the trial's principal investigator and lead author of the Lancet study. "The results of this study give healthcare providers on the front lines of the TB epidemic hope for better, faster tools needed to stop this disease."

A second trial called New Combination 2 (NC-002) was launched earlier this year to test the PaMZ combination over two months in patients, further advancing it through clinical development. NC-002 is currently enrolling patients and will be conducted at eight sites in South Africa, Tanzania and Brazil, and will build global capacity for TB trials.

In addition to these results, pharmaceutical companies are seeking regulatory approval for individual TB drug candidates -- advances made possible by the existence of the most promising research pipeline for TB drugs in history. TB experts say any new drugs for tuberculosis would be an extraordinary development, but that new TB drug combinations are potential game-changers due to their expected impact.

The NC-001 trial also validated the approach to development of novel regimens. Mario Raviglione, MD, Director of the Stop TB Department at the World Health Organization, said testing multiple new TB drug candidates simultaneously has already proven to be a major advance.

"Because of testing drugs in combination, we have already saved several years in the research process to find new, effective regimens to treat TB," Raviglione said. "The results look strongly promising from this early trial. If further testing holds up these results and the regimen is affordable in poor countries, it is huge progress. We could shorten drug regimens substantially for everyone, regardless of whether the form of TB is sensitive or multi-drug resistant. That would be a dramatic step forward."
